Partner Terms
Last updated September 11, 2026. Version history
In plain language
Applies to every company that receives a file from Practition Finance.
Two tracks: Referral and Lead Purchase.
Version 2.2 is accepted at the Accept click, before any unredacted detail is released.
1. Role
Practition Finance is an independent business financing referral service. It refers an inquiry and nothing more. It does not quote rates or terms, compare or rank offers, negotiate, prepare a partner application, or act as an agent of the partner or of the practice.
The partner receiving a file is the licensed partner of record for anything it offers. The partner communicates every offer, rate, term, and state disclosure to the practice directly, and is responsible for its own licensing, disclosures, and compliance.
2. Tracks
Referral track: the partner pays a referral fee equal to 50 percent of the fee the partner earns on a referred account that is funded or activated, renewals on that account included. Nothing is owed on a file that does not fund.
Upsell revenue on a referred account carries a 50 percent share for 24 months from funding.
Lead Purchase track: in California and Missouri, a partner pays a fixed fee per transferred inquiry, stated in the offer, whatever the outcome.
3. Offers and the Accept click
An offer arrives redacted and expires 24 hours after it is sent. Accepting releases the unredacted file; passing or letting it expire releases nothing.
A partner must accept the current version of these terms at the Accept click before any unredacted detail is released. Eligibility to receive offers does not depend on the terms version a partner last signed.
4. State clause
Merchant cash advance and other revenue-based financing structures must not be offered to a practice in Texas, Virginia, and Connecticut on any file received from Practition Finance. Where a file's product class is unknown, the offer states that those structures may not be offered.
In California and Missouri, the partner is the party that contacts the practice, takes the application, and arranges any financing.
Practition Finance does not do business in North Dakota.
5. What a partner receives
A file arrives redacted. Industry, state, revenue band, time in business, amount requested, and use of funds are visible before a decision. Contact name, business name, phone, and email release only after the partner accepts, and on the purchase track only after payment clears.
Files are non-exclusive by default: more than one partner may hold the same file at once. In California and Missouri, a file sold to a partner is exclusive to that partner for 90 days from the date of the sale, and Practition Finance sends that file to no other partner during that period. When the 90 days end, the file returns to non-exclusive.
6. Consent and contact limits
Every file carries a consent record with the wording, version, timestamp, and IP. A partner contacts the operator only through the channels that record permits. A file marked call only carries no text or email permission.
A partner honors any opt-out immediately and reports it back within 1 business day so the suppression is recorded here.
7. Price and payment
Purchase-track files carry a per-file price stated in the offer email. Leads are individually priced; the price is on every offer. A prepaid credit consumes on accept. Without a credit, an invoice issues on accept and the full file releases when payment clears.
Amounts owed are payable within 7 days of the invoice date.
Referral-track files carry no purchase price. Compensation on those files is described at /legal/compensation.
8. Data handling
A partner uses a file only to evaluate and provide financing for the operator who submitted it. Resale, list building, and transfer to another company are not permitted.
A partner deletes or returns file data on written request, subject to the records the partner must keep by law.
9. Representations and warranties
Licensing. The partner represents and warrants that it holds, and will keep in good standing, every license, registration, and bond required to receive, evaluate, and act on financing inquiries in each state it has selected as a state it serves.
The partner will stop accepting files from any state where that stops being true, and will notify Practition Finance in writing within 5 business days of any lapse, suspension, or regulatory action.
Practition Finance relies on this representation in referring inquiries. It is a material term of these Terms. A breach is a material breach and permits Practition Finance, at its sole discretion and without notice, to suspend or end the relationship, withdraw any pending files, and recover any losses the breach causes.
10. Standing and removal
A partner states the legal entity name and the licenses or registrations under which it operates. A change to either is reported within 10 days.
The licensing representation under Representations and warranties governs termination for a licensing breach: a breach permits suspension or termination at the sole discretion of Practition Finance, without notice, together with withdrawal of pending files and recovery of losses.
Practition Finance may stop sending files at any time, and removes a partner from the roster at /legal/partners on request or on a finding of a term breach.
11. Version
These terms are version 2.2, effective September 18, 2026. Each version is stored with the accepting name, timestamp, and IP on the partner record.
Version 2.2 is published and takes effect September 18, 2026. Until that date these terms govern, and nothing is stamped against the later version.
When a version requires re-acceptance, the next Accept click prompts for it, and no unredacted detail is released until it is signed.
Disclosures effective September 25, 2026, version 7.
